The contract is between Musa Bwanali (the photographer) and the client as detailed below:


1. A SUMMARY OF THE CONTRACT


The photographer is responsible for providing the client with photography services and products as detailed in the invoice sent to the client. The client undertakes to engage the photographer for this coverage for the price as detailed in the invoice.


2. THE COVERAGE


Photography will be provided by Musa Bwanali using the details provided on the booking form. Musa Bwanali cannot be held responsible for the lack of coverage caused by the client or other members of the client's group not being ready on time, nor by restrictions placed on the photographer by venue owners. Musa Bwanali does not guarantee any specific picture although every effort will be made to interpret the client’s wishes.


3. PAYMENT ARRANGEMENTS


The client will pay the photographer a total fee of £ (the price of the package) subject to the following terms:


A non-refundable £50 booking fee to secure the date and payable on execution of this agreement. This booking fee is non-refundable.


Full payment will be due 2 weeks after the event.


Cancellation less than 5 days before the date of the wedding will require payment in full. All cancellations must be via email and the client must confirm the photographer has seen the request.


The fee for postponed events is subject to change at Musa Bwanali's discretion.


4. COPYRIGHT


The entire copyright in the photographs is retained by Musa Bwanali s at all times throughout the world. Where a gallery of photos has been provided to the client, these photographs may be printed, and displayed online, for personal but not commercial use.


The photographer retains the right in all cases to use the photographs in any manner at any time and in any part of the world for the purposes of advertising or otherwise promoting their work.


The photographer grants a limited, non-exclusive license to the client and authorized representatives to use the photographs for official business purposes. This license allows the photographs to be used in company publications, marketing materials, presentations, website content, and other company-related promotional activities. Any usage beyond the scope of this license requires prior written consent from Musa Bwanali.


5. IMAGE SIZE, COLOUR, STYLE AND COMPOSITION ALL IMAGE SIZES ARE NOMINAL.

The photographer will provide a pleasing colour balance but cannot guarantee exact colour matching. It is sometimes not possible to record or print the exact colour as seen by the human eye. There is no right to reject on the basis of style or composition. All images will be adjusted for exposure, brightness, contrast, sharpness, etc according to the photographer’s judgement. Retouching, digital manipulation and artist finishings are not included.


6. ATTENDANCE


In the unlikely event that the appointed photographer is unable to complete the coverage due to unforeseen circumstances, Musa Bwanali reserves the right to appoint another photographer to attend on their behalf to undertake the photography.


7. INDEMNITY


The photographer shall only be responsible for obtaining any clearances for third-party copyright works, trade marks, designs or other intellectual property if this has been expressly agreed upon before the event. In all other cases, the client shall be responsible for obtaining such clearances and will indemnify the photographer against all expenses, damages, claims and legal costs arising out of any failure to obtain such clearances.


8. LIMITATION OF LIABILITY


In the unlikely event of a total photographic failure or cancellation of this contract by either party or in any other circumstances, the liability of one party to the other shall be limited to the total value of the contract. Neither party shall be liable for indirect or consequential loss.

9. WEATHER AND/OR DELAYS


Weather permitting, the photographs will be taken as agreed. In the event of inclement weather, the photographer, in cooperation with the client, will make the necessary changes to the schedule and will do their best to produce coverage of the event within the time allocated to them.


10. REQUESTED PHOTOGRAPHS


Musa Bwanali will honour requests for specific photographs subject to the following: weather and time permitting; availability and the cooperation of the person(s) concerned. All such requested photographs must form part of the client’s final gallery. The photographer can refuse requests if they pose a risk to health or damage to equipment and if it stops the photographer from capturing other key moments of the day. Any directions issued to clients or by clients, their guests or employees during a photographic shoot are deemed to be at said person's own risk. The photographer cannot be held responsible for any personal accidents during a photography shoot. 


11. PRINTS / REORDERS

All prints and reorders shall be treated as an extension of this contract and no responsibility for error will be accepted unless orders are given in writing.


12. FORCE MAJEURE OR ACT OF GOD.

The due performance of this contract is subject to alteration or cancellation by either party owing to any cause beyond their control. Although all equipment is checked regularly and reasonable steps are taken to ensure backup equipment is available, the photographer will not be responsible for photographs that are not produced due to technical failure.


13. HARASSMENT


The Clients acknowledge that they are responsible for ensuring appropriate behaviour by their guests and other vendors. In the event that the Photographer identifies any inappropriate, threatening, hostile, or otherwise offensive behaviour directed at them, their assistants, or their equipment, Photographer reserves the right to end coverage of the events, retain all fees paid by the Client, and hold no further responsibilities to the Clients. The photographer agrees to notify the Clients of any of the above-listed behaviours and give them an opportunity to correct such behaviours or remove the offending individuals from the venue prior to ending event coverage.


14. DELIVERY


We will endeavour to deliver digital files as quickly as possible on average within 14 days. The images will be delivered via an online gallery that will be valid for 6 months. The client is responsible for downloading all files within the 6 month period.

15. GOVERNING LAW

This agreement shall be governed in accordance with the laws of England and Wales.

FAQ

Where are you based and do you travel?

I'm based in London and yes I love to travel! If you want me to photograph your event, it will require a travel fee, depending on where it takes place.

When will we get our photos?

You will receive an online gallery link with all your photos within 14 days.

How many pictures will we receive?

All the good ones! Headshots - 3 images per person. And for events - depending on how many hours - between 100 - 500 well-curated and edited hi-res images.
